Leave - (a) Every employees who has been in employment for not less than twenty days in a year shall be entitled to one day?s earned leave for every such twenty days. Provided that a young person shall be entitled to one days earned leave for every fifteen days of employment during the year. (b) If an employee is discharged or dismissed from or leaves service during the course of the year, he shall be entitled to leave with wages or wages in lieu of unavailed leave at the rates laid down in clause (a). |

| Bihar | Section 17 Bihar Shops and Establishments Act, 1953If the employment of an employee who is entitled to leave under sub-section (1) or sub-section (2), as the case may be, is terminated by the employer before he has taken the entire leave to which he is entitled or if, having applied for and having not been granted such leave, he quits his employment before he has taken the leave, the employer shall pay him the amount payable under section 17 in respect of the leave not taken, and such payment shall be made before the expiry of the second working day after the day on which his employment is terminated and to an employee who quits his employment on or before the next pay day. |

(4-A) The services of an employee shall not be terminated unless a notice of thirty days for such termination has been given to him or unless, in lieu of notice, the employer has paid to the employee wages for one month calculated at the rate payable on the date of the notice of termination of service : Provided that no such notice or payment of wages in lieu of such notice shall be necessary if the termination of service is made as a measure of punishment or if the termination is under an agreement between the employer and employee concerned, which specifies a date for the termination of service. |
